Unfortunately, the law is written so broadly that it will apply to victims and thugs alike. Moreover, if you are the victim of someone's mistake, haste or prejudice, that's just tough.

Look, civil suits take time and effort. A much simpler way to handle this is provided by the current bill in Texas: if you feel your loved one should not have been shot, all you need to do is invite the shooter over to your place and hope he/she shows up a few minutes early.
